EQUITY's AGENTS' CODE OF CONDUCT

1)         The agent shall not claim to have authority to represent or offer the services of a client, except with the specific consent of that client.

 

2)         The agent shall not represent a client who has previously been represented by another agent, without making every reasonable endeavour to satisfy him/herself that the said client has previously, in writing, terminated their representation.  He/she shall use his/her best endeavours to conclude a mutually satisfactory arrangement over commission that may be payable to the previous agent.

 

In respect of background and walk-on work, the agent shall not seek to obtain the exclusive rights of representation of the artist, nor shall he/she inhibit the artist from registering with other agents or seeking work direct from the employer.

 

3)         The agents terms of business, including current commission rates, shall be clearly stated in writing and agreed at the time of representation/engagement.  Any variations in commission rates thereafter must be notified and agreed in writing with the client.

 

4)         No agent, when advising or negotiating on behalf of a client will be governed by any consideration other than a conscientious regard for the professional welfare of the client.

 

5)         Agents shall operate a separate client account and shall account for, and remit within 10 days all monies they receive on behalf of their clients.

 

6)         Agents shall allow their clients the right to verify and authenticate any statement of their account, and shall regularly provide their clients with the full details of all transactions handled on their behalf.

 

7)         The letter and spirit of all Equity Standard Contracts in all areas or the entertainment industry should be maintained and upheld at all times by all parties concerned.

 

8)         An agent acting as a promoter or employer shall not charge any commission/fees from the artist(s) employed.

 

9)         No agent having an interest in any enterprise, shall negotiate for the services or the property of a client, for any such enterprise without first disclosing the agents interest to that client.

 

10)              The client shall not solicit from the artist, any up front fees, goods or services as a condition of seeking work.

 

11)              It shall be the responsibility of the agent to ensure that the artist receives all relevant information relating to each confirmed booking.

 

If the agent wishes to check the availability of an artist, he must specify that he is, in no way, booking the artist on any given dates and that the artist is free to accept definite bookings from any other source.

 

12)              The agent should not approach any artist or production which he/she is aware is solely represented by another agent.

 

13)              If a sole agency agreement is terminated, the agent shall be entitled to commission on contracts concluded before the termination at the previously agreed commission rate three years from such termination.  In relation to variety contracted engagements, the period shall be 12 months.

 

14)              In cases where agents split commission, the commission agreement of the agent representing the artist or production, is the one to be signed, and that agent shall notify the management in writing that the commission is to be split.

 

15)              No agent may request the deduction of commission from an artist represented by another agent, unless requested to do so in writing by the artist.

 

16)              In the event of an agency partnership termination, the client must be advised immediately.  At this time arrangements must be put in place for the future payment of all fees to the client.

 

17)              In relation to variety engagements, the artist must be paid on the night/day of the performance unless otherwise agreed between the artist and the agent.
